Infrastructure/Major Projects

Our Infrastructure/Major Projects team has vast local and international experience advising sponsors, borrowers, contractors, financiers and other parties on commercial and financing aspects of major projects - including Public Private Partnerships (PPP).

Our team has advised on major projects in a wide range of industry sectors including infrastructure, energy, resources, tourism, health, defence and telecommunications. Our team draws on our specialist knowledge in areas such as finance, tax, property, construction, planning and environmental to ensure we deliver innovative and practical solutions to our clients.

Our team includes experts on the new PPP roading legislation, having advised the Ministry of Transport on the development of the Land Transport Management Act 2003. In addition, our lawyers have a wealth of PPP experience in international markets in areas such as road, rail and social infrastructure.

Our membership of the Minter Ellison Legal Group means that we work with the leading Major Projects practitioners in Australia who have helped to shape PPP legislation there. For example, Minter Ellison was retained by the Victorian Government's Department of Treasury and Finance to advise on documentation for the Partnerships Victoria initiative, the definitive PPP regime in Australia. Minter Ellison also assisted with the development of a Partnerships Victoria standard risk matrix and the overview documents. Our team works closely with our Australian counterparts in the Minter Ellison Legal Group and we have undertaken a number of joint initiatives in the area of PPPs which, together with our experience and our close links with government and major domestic and international industry players, mean that we are positioned at the forefront of PPP advisory work in New Zealand.

Infrastructure 2009: Delivering transport solutions in challenging times

The historic shortfall in public infrastructure, compounded by the current upheaval in the financial markets presents an unprecedented challenge for Australia's governments and the private sector.

But, with the right level of coordination and discipline, Australia is capable of attracting a mix of funding and delivery ideas that will strengthen the stock of national infrastructure and steer the economy towards recovery and longer term productivity.

Against this backdrop, Minter Ellison is pleased to release the second edition of its major thought leadership publication Infrastructure 2009: Delivering Transport Solutions in Challenging Times.

The publication helps to address a great challenge that faces today's policy makers: how to deliver expanded and more effective transport facilities and services at a time of economic downturn.

"Investing public funds in infrastructure is certainly a prudent and responsible way to inject money into the economy", according to Mark Birrell, National Leader of the Infrastructure Industry Group at Minter Ellison.

"It delivers badly needed, short-term outcomes in terms of employment and liquidity, but it also ensures solid long-term returns from investing in future productivity and economic growth," said Mark.

We hope the publication will provide a valuable platform for thoughtful discussion amongst both public and private sector participants on the right national approach to infrastructure delivery given today's challenging economic climate.
