Oliver is an experienced general litigator and specialises in handling complex commercial litigation as well as competition, regulatory and consumer law matters.

Oliver advises on contentious and non-contentious aspects of competition, regulatory and consumer law. He advises on mergers and acquisitions, restrictive trade practices, unilateral conduct and regulation. Oliver regularly advises clients in Commerce and Fair Trading Act investigations and with their interactions with the commercial regulators. He also advises on front-end compliance and, in the consumer law area, has represented clients before the courts and before the Advertising Standards Complaints Board.

From June 2020 to March 2021, Oliver is in a fixed term full-time role with the NZ Commerce Commission as General Counsel, Competition and Consumer.

Recent work

Merger clearances and investigations

Acted for Gasnet in a Commerce Commission investigation into whether the acquisition, by First Gas, of Gasnet pipeline assets in the Bay of Plenty substantially lessened competition.

Economic regulation

Provided legal advice to Wellington Electricity Lines Limited on its application to the Commerce Commission for “streamlined” approval to a new customised price-quality path.

Commerce Commission authorisation

Acted for the New Zealand Racing Board in its successful application to the Commerce Commission for authorisation to enter into commingling arrangements with Tabcorp Australia.

Fair Trading Act investigations

Represented Youi NZ and Trustpower in Commerce Commission investigations, and court proceedings, alleging misleading conduct in breach of the Fair Trading Act. Oliver also advises a range of other clients in active Commerce Commission consumer law investigations, and has represented clients before the Advertising Standards Complaints Board.

Gas price arbitration

Acted for Shell in a highly complex gas price arbitration concerning the Kapuni gas field. Oliver acts for Shell in related High Court proceedings.

'Class’ or representative actions

Acted for the auditors of failed finance company, LDC Finance, in proceedings brought by the liquidators and investors in the company against its former directors, accountants, auditors and trustee company.

Product recall

Advised Thule on the NZ aspects of its global recall of certain Sprint bike carrier models, and 2degrees in connection with the NZ recall of the Samsung Note 7.
