Senior Associate Pouarataki Pāhake

Brittany is an experienced construction and infrastructure lawyer with more than 10 years’ experience.

She is part of our front-end (transactional) construction team where she acts for both public and private sector clients. Her clients include developers and owners of major projects, government organisations as well as contractors for large-scale commercial and residential developments.

Brittany is a trusted adviser assisting clients at all lifecycle stages of a project – including procurement strategies and planning, contract drafting and negotiations, project governance and project administration. She advises on the full suite of project documentation (such as the NZS391X, ACENZ CCCS and NZIA forms) and bespoke documentation.

Brittany began her legal career as a commercial disputes lawyer, with a focus on the construction sector. She was involved in project disputes during and after the construction phase, including those relating to latent defects, variations, extensions of time and delay, payment issues, bonds, and negligence. This experience has developed her appreciation of risk areas when advising on the procurement and contract phase.

Career highlights

Acting for both Te Whatu Ora - Te Toka Tumai Auckland (formerly Auckland DHB) and Te Whatu Ora - Taranaki (formerly Taranaki DHB) on their core development programmes – ‘FIRP’ and ‘Maunga Stage 2’ respectively. This includes working with a cross regional group in developing a new format ‘Major Works Contract’.

Acting for Generus Group on its development of a new multi-stage premium retirement village in Parnell. Assisting Generus’ in-house team and project manager with project documentation and contract administration.

Part of the team assisting Kiwi Property with the creation of a new town centrea in Drury, Auckland. When complete, it will be a mix of residential, retail, commercial and community/civic uses. Involvement at the early stage of the project has included project documentation and key stakeholder negotiation.
